What does Real Decreto 239/2026 ask of a clinic's staff records?

Since 1 July 2026 every health centre in Spain must keep current information on all its health staff and a personal file for each professional showing their official degree and specialty, and new staff must be told the centre's safe practices. Centres have six months from that date to bring their staff information up to date.
The new artículo 7
Real Decreto 239/2026, published in the BOE on 26 March 2026 and in force from 1 July 2026, added an artículo 7 on garantías de atención sanitaria to RD 1277/2003.1 Centres and services must ensure, for as long as they operate, that care is given by staff with the official degree and the professional competences the work requires, read against the unit definitions in anexo II and, where one exists, the official specialty training programme.1 They must keep current information on all their health staff, whatever the legal relationship or place of work, keep that data current in the Registro Estatal de Profesionales Sanitarios, hold a current personal file for each professional with the official degree and specialty, and tell newly hired staff about the safe practices in place.1
The decree's first additional provision gives centres six months from entry into force to have that information up to date.1 Its second gives the comunidades one year to adapt the care offer they authorise to the amended annexes.12
What Madrid and Cataluña check on top
| Comunidad de Madrid | Cataluña | |
|---|---|---|
| Responsible person | A Director Técnico Asistencial with degree, colegiación and liability insurance | A responsable assistencial, with a referent de seguretat del pacient |
| On application | Final staff list signed by the Director Técnico Asistencial, degrees, colegiación certificates, liability insurance | Current staff list with name, DNI or NIE, degree and colegiación number, and the contracts |
| After opening | Every joiner and leaver notified, with no fee | The contracts linking each professional to the centre |
| At the centre | The current staff list available for inspection, and staff lists displayed6 | Each role accepted in writing |
Madrid requires every centre to have a Director Técnico Asistencial who is a qualified, registered and insured health professional, every member of staff to hold the degree, colegiación where it is compulsory and current insurance, the current staff list to be kept at the centre for inspection, and every change to the health staff to be notified.3 Its application asks for the staff list signed by the Director Técnico Asistencial with each degree, colegiación certificate and liability policy.4 Cataluña's application asks for an organigram naming the responsable assistencial and the patient safety referent, each accepting the role, and a current list of all health staff with degree and colegiación number.5
- List every health professional. Employed, self-employed or contracted, at every site, whatever the legal relationship.
- Open a personal file for each. The official degree and, where it applies, the official specialty, with a copy of each title.
- Add the regional items. Colegiación and professional liability insurance in Madrid, colegiación number and contract in Cataluña.
- Match competences to units. Check each professional against the anexo II definition of the unit they work in.
- Induct every new joiner. Record the date each was told the centre's safe practices.
- Notify changes the same week. In Madrid every joiner and leaver goes to the Consejería through the Cuenta Digital.
