Opening a clinic in Chicago

How to open a medical practice in Chicago

The Illinois Department of Financial and Professional Regulation licenses the physician and issues a separate physician controlled substance licence, while the Illinois Department of Public Health licenses a location as an ambulatory surgical treatment center when surgery is more than half of its activity. From the first appointment, wai runs booking, signed notes, recorded consent and patient messages on one record, in Spanish, Polish or any language your patients write in.

How to open a clinic in Chicago, step by step

From the licence to the first 90 days, in the order a founder meets each step.

01Licensing and the regulator

Who licenses a medical practice in Chicago, and in what order?

IDFPR licenses physicians and surgeons, and issues the physician controlled substance licence.1 IDPH licenses ambulatory surgical treatment centers, a building devoted primarily to surgery, where surgical procedures are more than 50 percent of the activity at that location.2

  • Hold an Illinois licence for every physician and surgeon, applied for in IDFPR's online system.1
  • Add the physician controlled substance licence from IDFPR for every physician who will prescribe them.1
  • Register with the DEA in Illinois. A practitioner's registration rests on a state licence, and DEA requires a separate registration in each state.3
  • Count the surgery. A location where surgery is more than half of the activity is licensed by IDPH as an ambulatory surgical treatment center.2
  • Get an NPI, then enroll. Apply through NPPES, then enroll in Medicare through PECOS, where most physicians complete the CMS-855I.45

02Premises and fit-out

What must a Chicago office be ready for before it gives anesthesia?

Illinois sets the rule for anesthesia in a physician's office, meaning any practice location not regulated as a hospital or a licensed surgical center.6 The operating physician needs anesthesia training and experience, unless an anesthesiologist gives it.6

  • Certify the team in ACLS before the first anesthetic, for every operating physician and anesthesiologist, and keep it current.6
  • Put the CRNA arrangement in writing. A practice agreement with a nurse anesthetist documents the ACLS and the physician's training.6
  • Plan a move with the review board. A licensed surgical center relocating contacts the Health Facilities and Services Review Board.2

03Indemnity and insurance

What should a Chicago practice know about malpractice claims?

A malpractice suit in Illinois is filed with an affidavit, usually backed by a reviewing health professional's written report made after a review of the medical record.7 The record your practice keeps is the record that report is written from.

  • Keep notes contemporaneous and signed, because the reviewing professional reads the medical record and other relevant material.7
  • Know the biometric exposure. BIPA allows $1,000 for each negligent violation and $5,000 for each intentional or reckless one, and excludes information captured from a patient in a health care setting.8
  • Record openly. Using a device surreptitiously to record a private conversation without the consent of all other parties is eavesdropping, even for a party to it.9

04Hiring and credentialing

What does a Chicago practice check before a clinician's first shift?

Illinois uses uniform forms for credentialing under the Health Care Professional Credentials Data Collection Act, sent to the entity doing the credentialing rather than to the state.2 For office anesthesia, the physician's training must be documented.6

  • Look up every licence on IDFPR's license look up, the physician and the controlled substance licence both.1
  • Track anesthesia CME. Without hospital or surgical center privileges, 8 hours for conscious sedation, or 34 for deep sedation, regional or general anesthesia, in each 3-year renewal period.6
  • Count it toward renewal. That CME and the ACLS training apply to the 150 hours a licence renewal requires.6

05Patient-facing setup

What does a Chicago practice set up before the first patient?

Recording consent from every party, a business associate agreement with every vendor that handles patient information, and written AI notice for therapy.910 A therapy practice tells the patient in writing that AI will be used, and for what, before a session is recorded or transcribed.11

  • Answer in Spanish and Polish. 607,865 Chicagoans aged five and over speak Spanish at home, and 67,932 speak Polish, Russian or another Slavic language.12
  • Keep therapy decisions with the therapist. AI may support scheduling, billing and notes, but may not make therapeutic decisions.11
  • Put consent in the booking, so the all-party yes is on file before the visit starts.9

06The first 90 days

What matters in a Chicago practice's first 90 days?

The prescribing check that starts on 1 January 2027. Under Public Act 104-0512, each prescriber or designee documents an attempt to review the patient's ILPMP profile before prescribing any C-II opioid, C-IV benzodiazepine or an initial C-II stimulant.13

  • Set up ILPMP access now for every prescriber and designee, before the duty begins.13
  • Keep ACLS current for everyone giving anesthesia in the office.6
  • Diary Medicare revalidation, every five years or when CMS asks.5
  • Trace one patient end to end from booking to follow-up, the way a surveyor does.14

What a well-run clinic gains

Patients answered within the hour, clinicians home on time and diaries that stay full, in published research.

  1. 7x

An enquiry answered within the hour is nearly seven times as likely to become a real conversation.15

  2. 30%

Clinicians using an ambient scribe did 30% less work after hours.16

  3. 23%

Patients sent a notification before their visit were 23% more likely to attend.17

Questions

Do Illinois physicians need a state controlled substance licence?

Yes. IDFPR issues a physician controlled substance licence alongside the physician and surgeon licence.1 The DEA registration is separate, and is held in each state where the physician prescribes.3

When does a Chicago practice need an ASTC licence?

When it is devoted primarily to surgery, with surgical procedures making up more than 50 percent of the activity at that location.2 IDPH licenses those centers.

What does Illinois require for anesthesia in a physician's office?

The operating physician needs anesthesia training and experience, shown by privileges or CME, unless an anesthesiologist gives it.6 Everyone giving anesthesia holds current ACLS.

Is Illinois a one-party or all-party consent state?

All-party for private conversations. Recording one surreptitiously without the consent of all other parties is eavesdropping, even for a party to it.9

Can an Illinois therapist use AI for notes?

Yes, as supplementary support with the therapist responsible for every output.11 A recorded or transcribed session needs written notice and the patient's consent first.
