Summary
Chicago clinics can run AI notes and front desk replies once the patient has agreed to recording, since Illinois requires every party's consent. Therapy practices add written notice and consent before AI supports a recorded session, and BIPA's health care exclusion covers voice captured from patients for treatment.
Chicago clinics can close every evening with the inbox answered in Spanish and English and every note signed. Illinois law gets them there through consent before recording and a clinician who stays responsible for every output.

The private care market in Chicago
Chicago had an estimated 2,731,585 residents on 1 July 2025, and its health care and social assistance businesses took $32.0 billion in receipts in 2022.1 11.0% of residents under 65 have no health insurance, so clear self-pay prices and a deposit at booking matter to a large share of patients.1
Across Cook County, the Census Bureau counted 3,409 offices of physicians in 2023, employing 42,167 people, within a health care and social assistance sector of 16,621 establishments.3
The rules a Chicago clinic works under
Physicians and surgeons in Illinois are licensed by the Illinois Department of Financial and Professional Regulation, which also takes complaints and renewals.4 Illinois adds three rules of its own to HIPAA.
Under 720 ILCS 5/14-2, a person commits eavesdropping by using a device in a surreptitious manner to record a private conversation to which they are a party without the consent of all other parties.7 Record openly, with the patient's agreement on file, for every consult.
The Biometric Information Privacy Act covers voiceprints and allows $1,000 in liquidated damages for each negligent violation and $5,000 for each intentional or reckless one.5 Its definition of a biometric identifier excludes information captured from a patient in a health care setting, and information collected, used or stored for treatment, payment or operations under HIPAA.5 A scribe recording a consult for the clinical note sits inside that exclusion. Review staff voice data and any use outside care separately with counsel.
The Wellness and Oversight for Psychological Resources Act, Public Act 104-0054, took effect on 1 August 2025.6 A licensed professional may use AI for administrative support, such as scheduling, reminders and billing, and for supplementary support, such as preparing therapy notes, while keeping full responsibility for every output.6 Where a session is recorded or transcribed, the patient must first be told in writing that AI will be used and for what purpose, and must consent.6 AI may not make therapeutic decisions or talk with clients in therapeutic communication.6
wai hosts each clinic's records in its own country, under that country's rules. We set this up with your clinic. wai is compliant with these rules and built for clinics in Chicago. Chicago records stay in the United States, and the Checkout business associate agreement comes before go-live. Every note stays a draft until the clinician signs it, which keeps the therapist responsible for each output as Public Act 104-0054 requires.6
The languages Chicago patients write in
Of 2,567,182 Chicagoans aged five and over, 607,865 speak Spanish at home, 67,932 speak Polish, Russian or another Slavic language and 52,032 speak Chinese, in the 2020 to 2024 American Community Survey.2 Tagalog accounts for 20,222 more, and 35.4% of residents speak a language other than English at home.21
Spanish is the largest group by far. Replies are drafted in the patient's own language, since wai works in any language, and each one waits for a member of the front desk to approve it.8
What a demo shows in Chicago
The demo opens on a WhatsApp message in Spanish at 9:15pm, from a mother in Pilsen asking whether her son can have a sports physical before the season starts. wai reads it into the family's thread, checks each clinician's busy times in Google Calendar, Outlook or Apple Calendar, and drafts a reply with two open slots on Thursday. The front desk approves it the next morning.
The booking link takes a deposit in US dollars through the clinic's own Stripe account, and recording consent is taken at booking, so the consult starts with the all-party yes already on file. For a therapy practice, the written AI notice the Illinois law asks for can sit in that same booking step.6
After the visit, the clinician reads the drafted note beside the transcript, edits and signs. Bring last month's Spanish enquiries and see each one drafted.
For health systems, insurers and public bodies in Chicago
Chicago-area hospital groups, health plans and public agencies can have wai build a system under their own brand. The work begins with one pathway, and the contract settles data, configuration and model rights. See the organisations page.
Where to start
First, add an explicit recording consent to booking or intake, using the consent form template, so every consult meets 720 ILCS 5/14-2.7 Second, if the clinic offers therapy, write the plain notice that names the AI tool's purpose and collect a written yes before any session is recorded.6
Third, ask counsel to confirm that voice data stays within BIPA's health care exclusion, and keep staff voice data out of scope.5 Fourth, count last month's enquiries by language and hour and bring them to the demo. Illinois law is set out here as read on 15 October 2026, as general information for the clinic's counsel to confirm.
Bring last month's evening enquiries in every language, and see how many become booked visits by morning.
Frequently asked questions
Is Illinois a one-party or all-party consent state?
All-party for private conversations. 720 ILCS 5/14-2 makes it eavesdropping to record a private conversation surreptitiously, even as a party, without the consent of all other parties.7
Does BIPA apply to an AI scribe recording a consult?
BIPA covers voiceprints, but it excludes information captured from a patient in a health care setting or used for treatment, payment or operations under HIPAA.5 Counsel should confirm the clinic's specific use.
Can an Illinois therapist use AI for notes?
Yes, as supplementary support, with the therapist responsible for every output. For a recorded or transcribed session, the patient must be told in writing and consent first.6
Who licenses physicians in Illinois?
The Illinois Department of Financial and Professional Regulation, which handles physician and surgeon licenses, renewals and complaints.4
Can patients write to a Chicago clinic in Spanish, Polish or another home language?
Where are a Chicago clinic's records hosted?
wai hosts each clinic's records in its own country, under that country's rules. We set this up with your clinic. For Chicago that is the United States, and therapy notes stay drafts until the therapist signs.
