Key points

Summary

A Bay Area clinic can use AI for notes and patient messages under HIPAA plus California's own rules. AI-written messages about a patient's clinical information need a disclaimer unless a licensed clinician reviews them first, every party must consent before a consult is recorded, and practices of any size now fall under the Data Exchange Framework. A system where the team approves each draft and the clinician signs clinical content meets the review route the law sets out.

Bay Area clinics now answer a patient in Mandarin at 11pm and have the clinician sign the follow-up by morning. California's rules for that kind of AI are specific, and each one is set out below with its code section.

The private care market in the Bay Area

The Medical Board of California counts 35,735 physicians with a renewed, current license across the nine Bay Area counties, 28% of the 127,714 with a California address.1 Santa Clara County has 10,052, San Francisco 8,213 and Alameda 5,796.1

Santa Clara and San Francisco together hold 18,265 of those physicians, just over half the regional total.1

The rules a Bay Area clinic works under

HIPAA sets the federal floor, covered in the guide to HIPAA and AI scribes. Physicians are licensed by the Medical Board of California, which also enforces the state's AI disclaimer rule against physicians.2

Health and Safety Code 1339.75, added by AB 3030, applies to clinics and physician offices that use generative AI to write patient communications about clinical information. Each one must carry a disclaimer and tell the patient how to reach a human, unless a licensed or certified health care provider has read and reviewed it.2 Appointment scheduling, billing and other business matters are outside the definition.2 With wai, the front desk approves booking replies, and a clinician reviews and sends every message about results.

Penal Code 632 makes it an offence to record a confidential communication without the consent of all parties, in person or by phone, with fines up to $2,500 per violation.3 Ask every patient before the AI scribe runs, and record the answer.

Civil Code 56.10, part of the Confidentiality of Medical Information Act, bars a provider from disclosing medical information without the patient's authorization except where the Act allows it.4 Confirm in writing which disclosures each subprocessor receives.

Health and Safety Code 130290 requires real-time exchange of health information under the Data Exchange Framework, and its exemption for physician practices of fewer than 25 physicians ended on 31 January 2026.5 wai is built to connect to the Data Exchange Framework. We set up your clinic's connection with you.

wai hosts each clinic's records in its own country, under that country's rules. We set this up with your clinic. wai is compliant with these rules and built for clinics in the Bay Area. A California clinic's records stay in the United States, and for Checkout a business associate agreement is signed before anything goes live.7

The languages Bay Area patients write in

43.9% of San Francisco residents aged five and over speak a language other than English at home, and 55.7% in Santa Clara County, according to the 2024 American Community Survey.6 Chinese, including Mandarin and Cantonese, is the largest in San Francisco at 16.5%, ahead of Spanish at 11.2%.6 Santa Clara is led by Spanish at 16.7%, then Chinese at 10.8% and Vietnamese at 6.8%.6

56.6% of San Francisco's Chinese speakers and 60.5% of Santa Clara's Vietnamese speakers report speaking English less than very well.6 In San Mateo County, 6.1% speak Tagalog at home.6 wai works in any language.8 The reply goes out in the patient's language after a member of the team approves it.

What a demo shows in the Bay Area

The demo starts with a WhatsApp message in Mandarin at 11pm from the Richmond District, asking for a first appointment this week. wai reads it, reads the clinicians' busy times from Google Calendar or Outlook and drafts a reply offering two open times. The coordinator approves it next morning, and the patient books and pays a deposit in US dollars through the clinic's own Stripe account.7

Next, after a consult in San Jose, wai drafts the letter explaining the plan to the patient, and it waits for the physician to read and sign it, the review that section 1339.75 recognises.2 A missed call from Oakland becomes a drafted text the team approves in the same thread.

Bring a real week of enquiries, sorted by language, and see which would have booked.

For health plans and digital health companies

Health plans and digital health companies in the Bay Area can build a product of their own on wai, under their brand, with model and data rights agreed up front and each clinical message routed for the review section 1339.75 recognises.2 The first build is one pathway with agreed measures, as the organisations page explains.

Where to start

First, sort the clinic's patient messages into clinical and administrative, and name the licensed clinician who reviews each clinical type, so section 1339.75 is met without a disclaimer.2 Second, add an all-party recording consent line to intake, using the consent form template.3

Third, confirm the practice has signed the Data Exchange Framework data sharing agreement now that the small-practice exemption has ended.5 Fourth, count last month's enquiries by language and hour and bring the count to the demo. This page is general information on California law as read on 14 October 2026, and the clinic's own counsel should confirm how it applies.

Send us one week of messages, and we mark which are clinical and who would review each.

Frequently asked questions

Does AB 3030 apply to AI-drafted booking reminders?

No. Section 1339.75 covers communications about patient clinical information and excludes appointment scheduling, billing and other business matters.2

Can a clinic skip the AI disclaimer on results messages?

Yes, if a human licensed or certified health care provider reads and reviews the message before it is sent. Otherwise the disclaimer and a route to a human are required.2

Is California a one-party or all-party consent state?

All-party for confidential communications. Penal Code 632 requires the consent of all parties, with fines up to $2,500 per violation.3

Does the Data Exchange Framework apply to a small private practice?

Yes, since 31 January 2026. The exemption for physician practices of fewer than 25 physicians ended on that date.5

Can patients in San Francisco and San Jose write in their own language?

Yes. wai works in any language.8 The team approves each draft before it reaches the patient.

Where are a Bay Area clinic's records hosted?

wai hosts each clinic's records in its own country, under that country's rules. We set this up with your clinic. For US clinics that means the United States.7
