Key points

Summary

A Philadelphia clinic can use AI for notes and the front desk in 2026, provided everyone in the conversation agrees before it is recorded and a licensed clinician signs every note. Pennsylvania's all-party consent rule, the State Board of Medicine's record rules and the breach notification act sit on top of HIPAA.

Philadelphia clinics sign every note before the patient reaches the street and answer every enquiry the morning after it arrives. Pennsylvania asks for two things to make that work, the agreement of everyone in the room and a licensed clinician behind every clinical word.

The private care market in Philadelphia

Philadelphia had 1,579,706 residents in the 2020 to 2024 American Community Survey, 7.1% of its civilian noninstitutionalized population uninsured, 14.7% aged 65 or older and 15.2% born abroad.8

The Philadelphia Department of Public Health runs City health centers that provide primary medical care to registered patients, sets health policy and takes guidance from the city's Board of Health.6 Private clinics work alongside that safety net, for patients who choose to book and pay directly.

The rules a Philadelphia clinic works under

HIPAA is the federal floor, and Pennsylvania sets its own recording and record keeping rules on top.

The State Board of Medicine regulates the practice of medicine through licensure, registration and certification across the Commonwealth.2 Its rule at 49 Pa. Code section 16.95 requires a physician to keep each patient's medical record for at least 7 years from the last service, and a minor's record until one year after the patient reaches majority.4

Section 5704(4) of the Wiretapping and Electronic Surveillance Control Act permits interception only where all parties to the communication have given prior consent.1 An ambient scribe in a Philadelphia consult room therefore starts only after the patient, and anyone with them, has agreed. The guide to US recording laws covers calls with patients in other states.

The Department of State warns that AI chatbots can get information wrong and that no AI chatbot is licensed to practise any health care profession in Pennsylvania, and it investigates complaints about chatbots offering unlicensed care.3 wai drafts, and a licensed clinician reviews and signs. On the front desk, a person at the clinic approves every reply before it is sent.

The Breach of Personal Information Notification Act, amended by Act 33 of 2024, requires concurrent notice to the Office of Attorney General when more than 500 Pennsylvanians must be told of a breach.5 A covered entity or business associate that complies with the HIPAA and HITECH privacy and security standards is deemed to comply with the act.5

wai hosts each clinic's records in its own country, under that country's rules. We set this up with your clinic. wai is compliant with these rules and built for clinics in Philadelphia. Philadelphia records stay in the United States, and a business associate agreement covers Checkout from its first day.9

The languages Philadelphia patients write in

362,262 Philadelphians aged five and over speak a language other than English at home.7 Spanish leads with 161,231 speakers, or 10.9%, followed by Chinese with 36,895, Russian, Polish or other Slavic languages with 24,221, French, Haitian or Cajun with 19,874 and Vietnamese with 14,422.7 11.5% of residents aged five and over speak English less than very well.7

wai works in any language.10 Every reply in Mandarin or Spanish is read and approved by a person at the clinic first.

What a demo shows in Philadelphia

The demo starts with an email in Mandarin sent at 9pm by a daughter in Chinatown, asking for a weekday visit for her father with an interpreter present. By 8am a Mandarin draft sits in the family's thread, offering weekday times that are open in the clinicians' Google Calendar, Outlook or Apple Calendar, ready for the coordinator to approve.

The daughter pays the deposit by card or Apple Pay into the clinic's Stripe account, and the family receives a confirmation, a receipt and an intake questionnaire.9 The clinic adds its all-party recording consent line to that intake, so agreement is on file before the patient arrives.

In the room, the clinician confirms consent aloud, then corrects and signs the drafted note before the next patient. The demo runs on an enquiry the clinic brings, in the language it arrived in.

For health systems, insurers and the city in Philadelphia

Philadelphia's academic health systems and health plans can run one care pathway on wai under their own name, then extend it once its measures hold. Who owns the data, the configuration and the model rights is settled in the contract, as the organisations page explains.

Where to start

First, write a two-sentence all-party consent script for the consult room and the intake form, starting from the consent form template.1 Second, set the record retention schedule to 7 years from the last service, and one year past majority for minors.4

Third, add the 500-person Attorney General threshold to the breach plan.5 Fourth, count last month's enquiries by language, so the demo runs on Spanish, Mandarin or whichever languages the clinic actually receives. This is general information on Pennsylvania law as read on 15 October 2026, to be confirmed with the clinic's counsel.

Bring your consent wording and last month's enquiries, and see both running on your own diary.
