The private care market in Las Vegas and Henderson

HIPAA sets the federal floor. Nevada adds a consumer health data law, written by SB 370 into NRS 603A.400 to 603A.550 and in force from 31 March 2024.²¹

NRS 603A.490 excludes any person or entity subject to HIPAA, so the law reaches health data held by businesses outside HIPAA.¹ Where it applies, NRS 603A.500 allows collection only with affirmative, voluntary consent or as needed for the service the consumer asked for, and sharing needs a second, separate consent obtained beforehand.¹ NRS 603A.510 gives 45 days to answer a request to confirm, list third parties, stop or delete, and NRS 603A.540 bans any geofence within 1,750 feet of an in-person care provider used to track, collect data from or advertise to patients.¹ A wellness or aesthetic practice should confirm with counsel which regime it sits under.
