Summary
A Berlin practice can use AI for consultation notes and patient messages in 2026 once the patient knows the conversation is recorded, a doctor signs every note and the records stay protected against alteration for ten years. The Ärztekammer Berlin sets the record duties, the Berlin data protection commissioner supervises the data, and the ePA connects the practice to the patient's statutory record.
Berlin practices that run on wai start the morning with every overnight message drafted for approval and end it with every note signed. The city's chamber code, the national data protection conference and the ePA set the terms, and each one is set out below with its source.

The private care market in Berlin
Berlin counted 3,917,196 residents on 30 June 2026, 14,551 more than a year earlier, and 972,941 of them held a foreign passport.1 Of those foreign residents, 59.1% held a European citizenship and 26.9% an Asian one.1
The districts differ sharply. The average Berliner was 42.9 years old, while Steglitz-Zehlendorf averaged 46.7 years and Charlottenburg-Wilmersdorf 45.3.1 Mitte had 145,983 residents with a foreign passport and Charlottenburg-Wilmersdorf 90,805, so a practice on the Kurfürstendamm and one in Wedding answer very different inboxes.1
More than 36,000 doctors live and work in the city, and the Ärztekammer Berlin is their professional body, a public corporation that runs membership, specialist training and continuing education.2
The rules a Berlin practice works under
The Ärztekammer Berlin code sets the record duty. Section 10 of its Berufsordnung requires doctors to record their findings and measures, to let patients inspect their records and take copies at cost, and to keep the records for ten years after treatment ends.3 Electronic records need special protective measures against alteration, destruction and unlawful use, and the chamber's recommendations apply.3 When a practice closes, the records are kept or handed into proper custody, and the chamber helps patients trace records when a practice can no longer be reached.39
The Berliner Beauftragte für Datenschutz und Informationsfreiheit is the city's data protection authority, and its site carries the reporting route for controllers who suffer a data breach.4 The Datenschutzkonferenz, Germany's conference of data protection authorities, published its guidance on AI and data protection on 6 May 2024.5
That guidance is direct on two points. An AI proposal with legal effect for a person must leave the deciding human real room to decide, and a merely formal human step does not count.5 Users should check whether inputs and outputs train the model, and tools that keep them out of training are preferable.5 wai drafts and a person at the practice decides, and patient data is never used to train models.
Recording a consultation needs the patient's agreement. Section 201 of the Criminal Code punishes anyone who records another person's non-public spoken word without authority with up to three years or a fine.7 The practice asks first, and the consent form template gives the wording.
The ePA is created automatically by the health insurer for every statutory patient who does not object, privately insured patients can use it too, and since 1 October 2025 medical facilities have had to work it into everyday care.6 wai is built to connect to the ePA. We set up your clinic's connection with you.
wai hosts each clinic's records in its own country, under that country's rules. We set this up with your clinic. wai is compliant with these rules and built for clinics in Berlin. For a Berlin practice that means Germany, with every draft, approval and signature written to a log the practice can export.
The languages Berlin patients write in
Berlin's register counts citizenship, which is the closest official guide to the languages a practice receives. On 30 June 2026, 27.9% of foreign residents held an EU passport, 31.2% a passport from elsewhere in Europe and 26.9% an Asian one.1
With any language understood, wai writes its draft in whatever language the family used, and nothing leaves until someone at the practice has read and approved it.8
What a demo shows in Berlin
The demo opens on an email sent at 23.10 by a woman in Charlottenburg who has just moved her elderly father to Berlin and wants a first appointment for him before his old prescriptions run out. wai places it in the father's own thread, reads the doctors' busy times from Google Calendar, Outlook or Apple Calendar and drafts a reply in her language with two open slots on Wednesday. The practice manager approves it at 7.50, before the phones open.
She pays a euro deposit by card or Apple Pay on the practice's booking page, the money lands in the practice's own Stripe account, and she receives a confirmation, a receipt and the intake questionnaire. After the visit the doctor edits and signs the drafted note and the letter for the father's specialist, and each signature is logged to the doctor's name, which is the alteration-proof record section 10 asks for.3
Bring last month's late messages, in the languages they arrived in, and judge the drafts on your own patients.
For hospital groups, insurers and public bodies in Berlin
For a Berlin hospital group, insurer or public health service, wai builds a system the organisation owns, carrying its own brand and hosted in Germany. The first build covers a single pathway with agreed measures, and the contract fixes who holds the data, configuration and model rights, as described on the organisations page.
Where to start
First, write the recording consent into intake and into the opening line of each consultation.7 Second, check the vendor's answer on training against the conference guidance, and put the answer in the contract.5
Third, confirm that signed notes are protected against later change and kept ten years, and agree what happens to the records if the practice closes.3 Fourth, name the person who files each signed letter to the patient's ePA.6 Bring a tally of last month's late messages to a Berlin demo, sorted by the hour they arrived. We read the Berlin code and the federal rules on 15 October 2026 for this page, and your own legal adviser has the final word on your practice.
Send us a week of messages from your inbox by hour and language, and we show the replies wai would have drafted for your team to approve.
Frequently asked questions
How long must a Berlin practice keep patient records?
The Berlin chamber code sets ten years from the end of treatment as the minimum, with any longer statutory period taking priority.3
Who supervises data protection for private practices in Berlin?
The Berliner Beauftragte für Datenschutz und Informationsfreiheit is the city's data protection authority and takes breach reports from controllers.4
Does German guidance allow an AI to decide on its own?
The data protection conference says a person must have real room to decide on any AI proposal with legal effect, and a formal sign-off alone is not enough.5 With wai a person at the practice approves every reply and the doctor signs every note.
Can we record consultations for an AI scribe in Berlin?
With the patient's agreement. Recording the non-public spoken word without authority is an offence under section 201 of the Criminal Code.7
Do Berlin practices have to use the ePA?
Since 1 October 2025 medical facilities have had to work the ePA into everyday care.6 wai is built to connect to the ePA. We set up your clinic's connection with you.
Where are the records held?
wai hosts each clinic's records in its own country, under that country's rules. We set this up with your clinic.
