How does a clinic register with the CRM and name a diretor técnico?

A private clinic that provides medical services registers with the Conselho Regional de Medicina of its state, through a request filed by its médico responsável técnico, under Lei 6.839/1980 and Resolução CFM 1.980/2011. The diretor técnico answers to the CRM, the sanitary authorities and the courts for how the clinic formally operates, under Resolução CFM 2.147/2016.

Who must register

Federal law requires companies to register with the professional council that supervises their core activity, and to record the qualified professionals in charge of them.¹ Resolução CFM 1.980/2011 applies that to medicine. Private companies that provide medical diagnosis or treatment register with the CRM of the state where they work, and the duty covers every branch and unit.² The request is filed by the médico responsável técnico and names the clinical staff, the specialties, the responsável técnico and the diretor clínico where there is one, with the municipal operating licence and the alvará da vigilância sanitária.²

What the diretor técnico answers for

The diretor técnico is responsible before the CRMs, the sanitary authorities, the Ministério Público and the courts for the formal aspects of how the establishment runs.³ The duties include checking every doctor's registration with the council and their specialist title, with copies kept in each doctor's file, keeping institutional advertising within CFM rules, and making sure the companies working in the institution are registered with the CRM.³ A doctor may be diretor técnico of at most two institutions, a specialised service needs a diretor técnico with the matching specialist title registered with the CRM, and direction must be exercised in person.³

1. Name the diretor técnico. A doctor registered with the CRM of the state, with the specialist title if the service is specialised.
2. List the corpo clínico. Every doctor, the nature of their tie to the company, and the specialties offered.
3. Collect the licences. The municipal operating licence and the alvará da vigilância sanitária come first.
4. File the request. The responsável técnico files it with the company's constitution, CNPJ and fees.
5. Display the certificate. Keep the Certificado de Inscrição de Empresa current and available to the public.
6. Diary the changes. Report any change within 30 days, and renew the certificate every year.

Keeping the registration true

Any change in the registered data must reach the CRM within 30 days, under pain of disciplinary proceedings against the responsável técnico, and the certificate is issued every year when there is nothing pending with the inspection department.² The diretor técnico answers ethically for every piece of information given to the councils, and the responsibility ends only when the CRM is told in writing that they have left.²
